Article 35a of Indian Constitution

Article 35a of the India constitution is not discriminatory. The learned brother and sisters who understand the constitution properly are aware that one part of the constitution cannot be ultra vires to another article of the constitution.

If a legislation is made under any article which is obsolete and discriminatory, the court has the power to examine the same. If the articles within the constitution are held discriminatory then the complete constitution needs a rejig.

The fundamentals of a law are dictated by the resolutions it holds for its citizens, like say for example if article 14 gives us the right to freedom, article 20 takes away that right to freedom from the sect who are offenders of law. Every article in the constitution has to go hand in hand complementing the diversity.

This contradiction to right of equality as “Charu puts is” is under “no threat” to women who have already pulled themselves out of penury and are in no desperate need to have a place to live in in their native state.

The bar to equality can be compared to rules made under “category of SC/ST”, where in the category of SC/ST people who pay taxes and have attained a financial status, cannot make claim of reservations as no right to equality gets hindered.

If Charu Wali Khanna feels under priviliged that Omar has a house in Kashmir and she does not, then she should have married herself in a Kashmiri Family and not a north Indian Punjabi family.

Interesting when she got married her husband’s family used to live in a rented apartment in Faridabad, today she boasts of multiple properties in posh Greaterr Kailash part — 2 Delhi.

The stage was set for her by her father who lives in near by Mandakini Enclave. The well guided political career of this woman started at the age of 35 when she appeared for law examinations. Just about after she completed 7 years in Supreme Court, she was well received in the pre-defined role of member women commission, which constitutional post was sacrosanct, however the question remains unanswered whether as to why more capable women were not given this post?

Since the government was in a strong position to set afoot and scrap article 370 of the constitution THIS ACT OF Charu Wali Khanna is in reality an attempt to make the matter sub-judice and linger the matter in the courts up to the time of elections. It is also to create a rift between PDP and the BJP governments.

Many feel this act of Charu should be viewed as a desperate political attempt of the congress to take the power out of the hands of the legislature due to their corrupt practtices.
